Terms of Service

These Terms of Service govern your use of DeepData Forensics, Inc. ("DDF") and the forensic analysis services we provide. DDF is a Delaware corporation. By submitting a contact or order form, you agree to these terms.

1. Services

DDF provides digital document forensics and metadata analysis services. Our technical reports and conclusions are based on forensic analysis and do not constitute legal advice. We make no guarantee as to the outcome or admissibility of findings in any legal proceeding.

2. Engagement & Scope

Each engagement begins upon mutual agreement of scope and fees. We reserve the right to decline any engagement at our discretion. The scope of analysis will be outlined prior to commencement of work.

3. Payment & Refund Policy

Payment in full is required prior to commencement of work. We reserve the right to withhold delivery of a final report until payment is received in full.

A full refund will be issued if work has not yet commenced on your engagement. Once any extraction or analysis has begun, no refunds will be issued. If you wish to cancel before work begins, please contact us immediately.

4. Confidentiality, Privilege and Restrictions

All documents and case information submitted to DDF are handled with strict confidentiality. We do not transfer your information to third-parties except as part of delivering our services (e.g., secure file storage), as required by law, or as instructed by our clients in writing.

We do not express an opinion on whether the transmission of documents or case information to DDF constitutes (a) a waiver of any privilege, immunity or basis for nondisclosure that otherwise might apply; and/or (b) the violation of any law or court order restricting dissemination. Please consult with your own legal counsel if you have any questions about whether the transfer of information to us is limited or prohibited.

If a law or court order requires DDF to sign an order or agreement with respect to information handling, please have your attorney or other representative in the case provide us with full details of the applicable rules and process before you submit any items for analysis. Inquiries concerning legal processes, orders or restrictions on our services must be submitted to DDF via our contact form.

5. Use of Findings

Our reports and findings are provided solely for your use in connection with the matter described at the time of engagement. Findings may not be shared, published, or used in any other context without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by law, DDF shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability in connection with any engagement shall not exceed the fees paid by you for that engagement. DDF disclaims any liability for the loss, corruption, or destruction of data or documents on the client's side prior to or during transmission to DDF. DDF disclaims any legal duty to persons other than its client.

7. Acceptable Use

You agree not to submit documents or information to DDF that has been obtained unlawfully, or the dissemination of which would be unlawful, or to use our services for any fraudulent or unlawful purpose. We reserve the right to terminate any engagement that in our sole opinion may be deemed unlawful.

8. Intellectual Property

All reports, methodologies, and work product produced by DDF remain our intellectual property until payment has been received in full, at which point a limited license to use the report only for the contracted purpose is granted to you.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of our services following any changes constitutes acceptance of the updated Terms.
